MATERNITY LEAVE

 

MATERNITY LEAVE

1. This leave is granted as per provisions of Maternity Benefit Act, 1961. It is applicable for only
those female employees, who are not covered under ESI Act, 1948, who have actually worked for a
period of not less than eighty days in the twelve months immediately preceding the date of her
expected delivery. The women employees who are covered under ESI Act, 1948, the
corresponding provisions shall prevail for them.

2. Entitlement shall be to receive maternity benefit of a total of 26 weeks of paid leave, whether
taken before or after the birth of the child or both combined together but not more than EIGHT
WEEKS before the birth of the child.

3. Women employees already having TWO children shall receive maternity benefit of 12 weeks of
paid leave.

4. Maternity leave must be applied for at least 6 weeks in advance, with requisite medical certificate,
stating the expected date of delivery.

5. In case of miscarriage or medical termination of pregnancy (in terms of Medical Termination
of Pregnancy Act,1971), on submission of requisite medical certificate, the employee will be
entitled to Maternity Benefit that is leave with pay for a period of 6 weeks immediately following
the day of the event.

6. In respect of tubectomy operation, the employee shall, on production of requisite medical
certificate, be entitled to Maternity Benefit that is leave with pay for a period of 2 weeks
immediately following the day of the event.

7. A woman employee suffering from illness arising out of pregnancy, delivery, premature birth of
child, miscarriage, medical termination of pregnancy or tubectomy operation shall, on production
of requisite medical certificate, be entitled, in addition, to Maternity Benefit that is leave with pay
for a maximum period of ONE MONTH. This leave extension, if any, shall have to be in
continuation.

8. A woman employee who legally adopts a child below the age of three months (through licensed
agencies only) or a commissioning mother shall be entitled to maternity benefit for a period of
12 weeks from the date the child is handed over to the adopting mother or the commissioning
mother, as the case may be.

# “commissioning mother” means a biological mother who uses her egg to create an embryo
implanted in any other woman.

To avail benefit, a woman employee shall have to declare herself as PRIMARY CARE GIVER and
submit requisite proof (registered Adoption Deed or the proof of child birth) while giving notice
of 4 weeks in advance, before proceeding on leave.

9. No encashment shall be permissible against un-availed maternity leave.

10. Intervening offs/ holiday shall be a part of leave.
